Terms of Service Relating to the IAA Website

1 General

1.1 The Duke of Edinburgh’s Award International Association (“IAA”) provides the public part of this web site (“the Service”) in accordance with the following Terms of Service (“TOS”). By using the Service you acknowledge that you understand and agree to abide by the TOS. The IAA may add features or services to the Site which unless otherwise stated will be subject to the TOS and may update the TOS without notice to you. You are advised to check periodically for updates to the TOS.

1.2 To use the facilities to make donations on-line and submit enquiries to the IAA you will be required to provide the IAA with certain personal information. Access to parts of the web site (“the IAA Intranet”) is restricted at the IAA’s discretion to certain categories of user. If you fall into such a category you will be provided with a password and will be required to observe further terms of service.

2 Service

2.1 The Service is provided for information and networking purposes only, and no content included in the Service is intended for trading or investing purposes. The IAA is not responsible for and accepts no liability for the accuracy, usefulness or availability of any content, or for any actions taken by you on the basis of any content.

2.2 The user is responsible for obtaining access to the World Wide Web, and paying service fees related to such access.

3 Liability

3.1 You use the Service at your own risk.

3.2 The Service is provided free of charge as available, and you understand and acknowledge that the IAA disclaims all warranties, express or implied, of any kind, and in particular the IAA makes no warranty that the Service will meet your requirements or will operate continuously, without error or delay or breach of security; that any Content, information, product, or services obtained via the Service will be satisfactory to you; or that errors in the software or code constructing or operating the Service will be made right.

3.3 Any and all material that you obtain through the Service is entirely at your own risk. Any damage to your computer or software, and any loss of data, through any download through the Service is entirely your responsibility. You should ensure that you have suitable and up-to-date antivirus and firewall software in operation to protect your computer and data.

3.4 No communication from the IAA or the Service shall create any warranty.

4 Privacy Policy

4.1 The IAA may collect personal information about users of the Service to improve the range and delivery of the Service, to maintain records of donations received and the identity of donors, and to respond to enquiries. The IAA may from time to time send registered users who consent to receiving such material information about IAA activities including the activities of national award associations and international organisations affiliated to the IAA. You may unsubscribe from these mailings at any time.

4.2 The IAA reserves the right without notice to bar any user found to be transmitting unsolicited commercial materials including advertising or promotional materials via the Service.

4.3 When you use the Service IAA sends a “cookie” to your computer. A cookie is a small computer file containing data that identify you as a unique user. IAA uses cookies to improve the quality of our service and to understand our user base more. IAA does this by storing user preferences in cookies and by tracking user trends. IAA will not disclose the data contained in its cookies to third parties except as required by a valid legal process such as a search warrant, subpoena, statute, or court order.

4.4 Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or to indicate when a cookie is being sent. Details of how to do this will be found under the “Help” command in your Web browser. Be aware, however, that some parts of the Services may not function properly if you refuse cookies.

4.5 The Service automatically receives and records information on its server logs from your browser including your IP address and the page you requested.

4.6 The IAA may send personally identifiable information about you to National Award Authorities and Independent Operators affiliated to the IAA, participants in IAA or affiliates’ activities and assessors and to other organisations involved in the International Award who need such information for the purposes of providing you with services you have requested. We may also disclose your personal information when we are legally obliged to do so or if your actions on the Service violate the TOS. The IAA will not disclose your personal information to any other party.

5 International Use

You agree to comply with all local regulations about online conduct and Content. You agree to comply with all laws regarding the transmission of technical data exported from the United Kingdom, the United States or the country in which you are resident.

6 Indemnity

You agree to indemnify the IAA and its affiliates, employees, agents, and officers against any claim or demand including legal fees made by any third party in regard to your use of the Service, violation of the TOS, or violation of any person’s rights.

7 Amendments

The IAA reserves the rights to amend or discontinue the Service or any part of it without notice. You agree that the IAA is not liable to you or any third party for any amendment or discontinuance of service.

8 Termination Of Service

You agree that the IAA at its own discretion may terminate your use of the Service including for the purposes of this clause any part of it for any reason, with or without notice; and that the IAA may remove and discard any Content for any reason, with or without notice. You agree that the IAA may terminate your access to the Service and may delete any files relating to your membership and bar any further access to such files or the Services. You agree that the IAA is not liable to you or any third party for termination of your access to the Services.

9 Links

The Service or third parties may provide links to other sites on the World Wide Web. You agree that the IAA is not responsible for the availability of external sites or resources, and is not responsible for any material contained therein, or reliance on such material.

10 Proprietary Rights

10.1 You acknowledge that the Service contains proprietary information, protected by intellectual property laws. You agree not to adapt, amend, rent, lease, loan, sell, distribute or create derivative works based on the Services or Software, in whole or part.

11 Notices

Notices to you may be made via either email or regular mail. The IAA may also provide notices of changes to the TOS or other matters by displaying notices or links on the entry page of the relevant part of the Services.

12 Copyright

12.1 Copyright subsists in the contents of the Service and in the Service itself as a compilation or database. The Service may also be protected by database right and by other intellectual property rights.

12.2 Trade marks and trade names, logo and other signs (“Trade Marks”) used in the Service whether or not registered as trade marks are the property of the IAA.

12.3 The inclusion of material on the Service confers no right on Members to do any acts that require the consent of the copyright owner in relation to any such material or to use any Trade Marks whatsoever.

13 General Information

The TOS constitute the entire agreement between you and the IAA and govern your use of the Service except when additional terms or conditions apply to particular elements of it. It overrides any prior agreements between you and the IAA. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third-party software. The failure of the IAA to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such rights or provisions. If any provision of the TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision, and all other provisions of the TOS remain in full force. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one year after such claim or cause of action arose or be forever barred.
